1. Acceptance of These Terms

These Terms & Conditions ("Terms") govern your use of caregivers.thehomecareagency.com (the "Site") and the services offered by Web Properties Corp, doing business as The Home Care Agency ("The Home Care Agency," "we," "us," or "our"). By using the Site or submitting a form, you agree to these Terms.

2. Nature of the Service

The Home Care Agency provides a free service that helps people who want to become paid caregivers get started — including family members seeking to care for a loved one through a state Medicaid program and caregivers seeking work with a licensed home care agency.

We are not a home care provider and we do not employ caregivers. We make no promise or guarantee of employment, enrollment, or program eligibility. Caregiver enrollment and employment are handled by independent, licensed home care agencies, and eligibility for any program is determined solely by the applicable state program.

3. Consent to Be Contacted & Text-Messaging (SMS) Terms

By submitting a form, you consent to be contacted by The Home Care Agency by phone call, SMS text message, and email, including through automated dialing systems and AI / artificial-voice technology. Consent is not a condition of any service or employment, and you may opt out at any time — reply STOP to any text message, or ask to be removed during any phone call.

(a) Program description

This messaging program is operated by Web Properties Corp, doing business as The Home Care Agency. When you submit a form on the Site with your mobile number and check the consent box (the box is never pre-checked), you may receive text messages from The Home Care Agency about your caregiver application — for example, a confirmation that we received it and messages coordinating a time to speak by phone — and occasional updates about caregiver opportunities. The Home Care Agency is the only sender of text messages under this program; no other party sends you text messages under this program. You must be at least 18 years old and the subscriber or authorized user of the mobile number you provide.

(b) Message frequency & rates

Message frequency varies; you will receive up to 4 messages per month. Message and data rates may apply — these charges are set by your mobile carrier and are your responsibility.

(c) HELP & STOP

For help at any time, reply HELP to any of our text messages or contact us using the details in the "Contact Us" section below. Text STOP at any time to cancel. After texting STOP, you will receive one confirmation that you have been unsubscribed and will receive no further messages. Opting out of text messages does not remove you from phone calls or email; to stop those, ask to be removed during any phone call or contact us directly.

(d) Carriers & delivery

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier and is not guaranteed.

(e) Messaging privacy

We do not share, sell, or otherwise provide your mobile phone number, mobile opt-in data, or SMS consent information to any third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, sold to, or transferred to any third party for any purpose. 4. Your Responsibilities

You agree to provide accurate and complete information about yourself and your caregiving situation.

5. Cost

Our service is free to you. There is no application fee.

6. Independent Agencies

The licensed home care agencies that handle caregiver enrollment and employment are independent third parties. The Home Care Agency is not responsible for and does not endorse, supervise, or guarantee the services, acts, omissions, licensing, or conduct of any agency. Any employment or enrollment relationship is solely between you and the agency.

7. Educational Information Only

Any information we provide about state Medicaid programs or caregiver compensation is general educational information only. It is not legal, financial, medical, or benefits advice, and program details change. Eligibility and compensation are determined solely by the applicable program.

8. Intellectual Property

All content on the Site is owned by Web Properties Corp (d/b/a The Home Care Agency) or its licensors and is protected by applicable intellectual-property laws.

9. Disclaimer & Limitation of Liability

The Site and our service are provided "as is" without warranties of any kind. To the fullest extent permitted by law, The Home Care Agency and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our service, the conduct of any home care agency, or any employment or enrollment outcome.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after a change takes effect means you accept the updated Terms.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles, and any dispute shall be resolved exclusively in the state or federal courts located in New York.
